By accessing or conducting transactions on this website or in-store, you acknowledge and agree to comply with these Terms of Use. These policies apply to all relevant website and store interactions. By using the website, you enter into a binding agreement with TikTech based on these terms, including any applicable policies.

Part I applies to both online and in-store orders, while Parts II and III specifically govern online and in-store transactions, respectively.

2. Definitions

For the purposes of these Terms of Use:

  1. “Affiliates” refers to entities, such as website operators, retailers, kiosk operators, or marketing companies, that have agreements with TikTech and receive compensation for directing business to TikTech.
  2. “Buying” refers to the purchase of any product by a customer from TikTech.
  3. “TikTech” includes TikTech Limited, its affiliated companies, and any stores operated under its franchise agreements.
  4. “Cookies” are small text files stored on your device by the website to maintain session information and identify your device.
  5. “Customer” refers to an individual or organization engaging in buying, selling, or exchanging products with TikTech, either in-store or online.
  6. “Exchange” involves trading one item for another, often with a cash, credit, or donation component.
  7. “Personal Information” encompasses the details provided during registration or membership and any subsequent updates to that information.
  8. “Product(s)” include movable items bought, sold, or exchanged with TikTech, including items submitted for sale but not yet processed.
  9. “Product Description” refers to the portion of the website detailing product features.
  10. “Selling” refers to the act of selling products to TikTech by a customer.
  11. “Store” represents a TikTech retail location.
  12. “User” means any person who accesses the website and/or is a customer.
  13. “Users” collectively refers to all individuals accessing the website.
  14. “Website” refers to TikTech.co.uk, its subdomains, and any successor URLs.

PART I: General

3. Product Warranty

3.1 12-Month Warranty:
All products come with a 12-month warranty unless otherwise specified. Specific exceptions are outlined in sections 3.1.1 and 3.1.2.

3.1.1 Exclusions: The warranty does not cover:

  • Physical or liquid damage.
  • Damage from rooting/jailbreaking devices.
  • Replaceable components such as battery covers, lens caps, and interface covers.
  • Products with single-use codes (e.g., activation or subscription codes).
  • Flip/Fold phones where the pre-installed screen protector is removed.
  • Items sold under the TikTech Apparels line.

3.1.2 Coverage for Consumable Parts:

  • Non-Sealed Components: Items like batteries, screen protectors, and other consumable parts are covered for 30 days post-purchase.
  • Sealed Components: Items such as sealed batteries are covered for the full warranty duration.

3.2 TikTech assumes no responsibility for data loss. Customers must back up and remove all data before submitting devices for testing, warranty claims, or sales.

3.3 Initial Faults: Products found faulty within 30 days will be refunded at the original purchase value via the same payment method.

3.4 Faults Within 6 Months: If a fault arises between 30 days and 6 months of purchase, TikTech will verify the defect and repair or replace the product. If repair or replacement is not possible, a refund will be issued as per the original purchase value.

3.5 Faults Between 6 and 12 Months: For faults arising after six months but within one year, TikTech will repair or replace the item. If a replacement has already been provided, refunds will be based on the current or original value, whichever is lower.

3.6 Returns Under Warranty: Customers bear the risk of loss and title for products sent to TikTech until the items are received.

3.7 Exclusions from Warranty: This warranty does not cover issues caused by misuse, neglect, improper installation, or unauthorized repairs.

3.8 E-Scooter Damage: TikTech is not liable for any damages or injuries caused by misuse or improper maintenance of e-scooters purchased from TikTech.

4. Returns Policy

4.1 TikTech will accept returns only if:
(a) A valid proof of purchase accompanies the returned product.
(b) The product includes all items originally provided at the time of purchase.

4.2 Returned items will be tested to verify the reported fault before a refund, repair, or replacement is processed.

5. Policy for Unwanted Products

Under TikTech’s exclusive 48-hour return policy, customers may return unwanted items within 48 hours of purchase for a full refund in the form of a TikTech voucher. Refunds are subject to testing to ensure the product is returned in its original condition. To prevent misuse, TikTech reserves the right to limit exchanges from specific customers.

6. Product Descriptions

6.1 Second-Hand Items: Unless otherwise specified, all products are pre-owned, and descriptions are for display purposes only. Product images are for illustration and may not match the final product.

6.2 Box Contents: Packaging and contents may vary, and downloadable content advertised on the box may not be included.

6.3 Product Grading:

  • Grade A: Mint condition.
  • Grade B: Good condition.
  • Grade C: Functional but with visible wear.
    Detailed grading criteria are available on the website.

6.4 Gaming Consoles: Consoles are categorized as Boxed, Unboxed, or Discounted based on their condition and packaging.

6.5 TikTech reserves the right to modify product prices without prior notice.

6.6 Apple Devices: Customers must remove iCloud accounts from Apple devices before selling or exchanging. TikTech will not accept responsibility for devices with active accounts or personal data.

7. Purchasing from TikTech

7.1 Customers are responsible for ensuring they have the necessary accessories, power supplies, and compatible devices to operate purchased products safely and effectively.

7.2 TikTech reserves the right to limit the quantity of any product sold to individual customers to maintain stock availability and natural price fluctuations.

8. Selling to TikTech

8.1 TikTech reserves the right to refuse the purchase of any product at its discretion.

8.2 Bulk sales may be subject to discounted pricing, which will be communicated before finalizing the transaction. If the discount is not accepted, the products will be returned to the customer.

8.3 Ownership of sold items transfers to TikTech upon successful testing and agreement of the purchase price. The seller guarantees the products are free from encumbrances or third-party claims. TikTech may pursue legal remedies if products are found to be stolen or counterfeit.

8.4 Prices quoted online are subject to change. Payments can be made via cash, bank transfer, or TikTech vouchers. Cash prices may differ from voucher or exchange offers. Vouchers are non-transferable by TikTech but may be sold by the customer at their own risk.

8.5 Customers must ensure all personal data is removed from devices sold to TikTech. TikTech is not responsible for data left on devices.

8.6 If the value of a purchase exceeds the voucher balance, the difference must be paid using an accepted payment method.

9. Registration/Membership

9.1 Customers registering with TikTech must:
(a) Provide true, accurate, and complete personal information.
(b) Update their account details as necessary.
(c) Avoid impersonating others or using unauthorized names.

9.2 Membership accounts are required for using TikTech’s buying, selling, or exchange services. Membership is valid for both in-store and online transactions.

10. Intellectual Property Rights

10.1 Copyright:
All content on the TikTech website and in its stores, including text, graphics, logos, button icons, images, audio clips, and software, is owned by TikTech or its content providers and is protected by UK and international copyright laws.

10.2 Trademarks:
TikTech trademarks, including logos, page headers, button icons, scripts, and service names, are protected trademarks or trade dress of TikTech or its subsidiaries. Unauthorized use of these trademarks is prohibited.

11. Export Restrictions

Certain products sold by TikTech may be subject to agreements that prohibit their re-exportation from the UK. Customers must secure appropriate approvals from relevant authorities before exporting any product purchased from TikTech.

12. Limitation of Liability

12.1 TikTech strives to ensure the accuracy of information on its website and in stores but makes no express or implied guarantees regarding its accuracy.

12.2 TikTech is not liable for:
(a) Economic losses.
(b) Loss of goodwill or reputation.
(c) Special, indirect, or consequential losses suffered due to the use of its products or services.

12.3 TikTech’s liability for defective products or breaches of these terms is limited to the purchase price of the relevant product.

13. Severability

If any provision of these Terms of Use is deemed unlawful, invalid, or unenforceable, it will be severed from the remaining provisions, which will continue to be valid and enforceable.

14. Indemnity

You agree to indemnify TikTech fully for any third-party claims arising from your negligence, misuse, or breach of these Terms of Use.

15. Notice

15.1 Notices under these Terms may be sent by hand, post, registered post, or recorded delivery and will be considered received during normal business hours.

All transactions with TikTech are governed by the laws of England and Wales. Disputes will be subject to the jurisdiction of the courts in this region.

18. Age Restrictions

18.1 Customers confirm they meet the minimum age requirement to purchase age-restricted products.

18.2 When purchasing on behalf of others, customers must ensure the recipient also meets the applicable age restrictions.

18.3 Customers under 13 may use the website only with parental or guardian supervision.

TikTech reserves the right to refuse service or cancel orders for customers not complying with these age requirements.

19. Force Majeure

TikTech will not be held liable for delays or failures caused by events beyond its reasonable control, including natural disasters, strikes, wars, or technical failures.

Part II: Online Transactions Only

20. Online Buying, Selling, and Exchanges

20.1 Placing Orders:
An order placed online becomes binding once it has been dispatched by TikTech. TikTech may cancel orders due to stock unavailability, payment issues, or breach of eligibility requirements.

20.2 Order Cancellation:
Customers may cancel orders up until dispatch.

20.3 Returns:
Unwanted products may be returned within 14 days of receipt in accordance with distance selling regulations. Refunds or exchanges outside this period are at TikTech’s discretion.

20.4 Delivery:
TikTech delivers only to the billing address registered with the customer’s payment method. Incorrect or incomplete addresses may result in failed deliveries, for which TikTech is not liable.

21. Delivery Policy

21.1 Delivery occurs when TikTech hands the product to the customer or designated recipient.

21.2 Late delivery does not entitle customers to:
(a) Reject the product.
(b) Cancel the order.
(c) Withhold payment.

Part III: Store Transactions Only

22. General

The agreement between TikTech and the customer for any product is established when the order is accepted by TikTech, either in-store or as per these Terms of Use.

23. Selling to TikTech

Ownership of products sold to TikTech is transferred once testing is completed, and a purchase price is agreed upon between TikTech and the customer.

24. Product Testing

24.1 While TikTech will take reasonable precautions to protect items left for testing, they are left at the customer’s own risk.

24.2 Products that fail testing or are rejected for purchase must be collected within 14 days. After this period, TikTech reserves the right to dispose of the items at the customer’s expense.

Additional Sections

25. Changes to Terms

TikTech reserves the right to amend these Terms of Use at any time. Continued use of the website or store services constitutes acceptance of any changes. If you do not agree to the updated terms, you must stop using TikTech’s services immediately.

26. Third-Party Links

TikTech is not responsible for the content or services of third-party websites or links provided on the website or in stores.

28. Warranty and Returns for In-Store Purchases

These Terms of Use, along with any referenced policies, constitute the entire agreement between TikTech and its customers and supersede any prior agreements or understandings related to the use of TikTech’s website or services.
